TERMS AND CONDITIONS – QUSTOM COLLECTIBLES (GRADING SERVICES & SALES)

1. INTRODUCTION
By submitting any item for grading, purchasing products, or using any services provided by Qustom Collectibles (“the Company”), you (“the Client”) agree to be bound by the following Terms and Conditions.


2. NO WARRANTIES ON ITEMS
2.1 All items sold by the Company are provided “as is” and without any warranties, whether express or implied.
2.2 The Company makes no guarantees regarding condition, authenticity (unless explicitly stated), grading outcomes, or future value.
2.3 The Client acknowledges that collectibles, trading cards, and similar items are inherently subjective and may vary in perceived condition and value.


3. GRADING SERVICES DISCLAIMER
3.1 Grading is an opinion-based service, and results may differ from other grading companies or future assessments.
3.2 The Company does not guarantee any specific grade outcome.
3.3 Once grading is completed, the assigned grade is final and non-negotiable.
3.4 The Company is not liable for any perceived loss in value resulting from a grading outcome.


4. CLIENT RISK – SHIPPING
4.1 All shipping of items to and from the Company is conducted entirely at the Client’s own risk.
4.2 The Company is not responsible for:

  • Loss or theft during transit

  • Damage incurred during shipping

  • Delays caused by couriers or external factors

4.3 Clients are strongly advised to use insured and trackable shipping methods.


5. CLIENT RISK – GRADING PROCESS
5.1 By submitting items for grading, the Client acknowledges that:

  • Handling is required as part of the grading process

  • There is an inherent risk of minor handling wear

5.2 The Company will take reasonable care but accepts no liability for damage, including but not limited to:

  • Surface scratches

  • Edge wear

  • Packaging defects

5.3 All grading submissions are processed at the Client’s own risk.


6. LIABILITY LIMITATION
6.1 To the fullest extent permitted by law, the Company shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits or market value

  • Claims exceeding the original declared value (if applicable)


7. DECLARED VALUE (IF APPLICABLE)
7.1 Clients may declare a value for submitted items.
7.2 This value is used solely for internal handling purposes and does not constitute insurance or liability acceptance.


8. RETURNS & REFUNDS
8.1 All grading services are final and non-refundable once work has commenced.
8.2 Product sales are final unless otherwise agreed in writing.


9. AUTHENTICITY DISCLAIMER
9.1 Unless explicitly stated, the Company does not guarantee authenticity.
9.2 Clients are responsible for ensuring the legitimacy of items submitted.


10. ACCEPTANCE OF TERMS
10.1 Submission of items, use of services, or purchase of products constitutes full acceptance of these Terms and Conditions.


11. GOVERNING LAW
11.1 These Terms and Conditions are governed by the laws of South Africa.
